FACESIFT — TERMS OF USE

Please read these Terms of Use carefully before using the FaceSift service. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service. Questions can be directed to facesift@gmail.com.

§ 1. Definitions

  • Service / Website — the FaceSift face reverse-image search platform, including all web pages, APIs, and content provided by the Operator.
  • Operator — the entity operating the FaceSift service, reachable at facesift@gmail.com.
  • User — any natural person who accesses or uses the Service.
  • Terms — these Terms of Use.
  • FaceCheck.ID — the third-party facial-search API provider used to perform image searches (facecheck.id).
  • NOWPayments — the third-party cryptocurrency payment processor used to handle crypto payments on the Service (nowpayments.io).
  • Lenso.ai — a third-party face reverse-image search service available on the /lenso page of the Website as an alternative search engine (lenso.ai).
  • Search Results — the list of publicly indexed web pages or images returned by FaceCheck.ID or Lenso.ai in response to an uploaded photo.
  • Unlock Payment — the one-time $1 payment required to reveal full, unmasked Search Result URLs.

§ 2. Eligibility and Age Restrictions

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

The Service must not be used to search for images depicting persons under the age of 18, for any purpose whatsoever.

The Service is not available to residents of Illinois (USA) due to restrictions under the Illinois Biometric Information Privacy Act (BIPA).

§ 3. Acceptable Use

The Service is provided exclusively for lawful, personal, and non-commercial purposes such as verifying the online presence of your own image or assisting with identity research where you have the legal right to do so.

You agree that you will NOT use the Service to:

  1. search for any person without their explicit consent, except where you have a lawful basis to do so;
  2. stalk, harass, intimidate, or harm any individual;
  3. collect or compile personal data about third parties without their knowledge or consent;
  4. facilitate discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic;
  5. violate any applicable law, regulation, or third-party rights, including privacy, intellectual property, and data-protection laws;
  6. upload images of minors under any circumstances;
  7. upload images that you do not have the right to share;
  8. attempt to reverse-engineer, scrape, or overload the Service or FaceCheck.ID API;
  9. use automated bots, scripts, or tools to submit searches without prior written consent from the Operator.

Violation of these rules may result in immediate suspension of access and may be reported to relevant authorities.

§ 4. User Representations on Upload

By submitting a photo to the Service, you explicitly represent and warrant that:

  1. the photo depicts only yourself, or a person for whom you hold lawful authority to conduct such a search;
  2. the depicted person is 18 years of age or older;
  3. you have the legal right to upload and process this photo in your jurisdiction;
  4. use of the Service, including sending the photo to FaceCheck.ID servers, is not prohibited by the laws of your jurisdiction;
  5. you agree to the terms of FaceCheck.ID as the downstream processor of the photo data.

If you cannot honestly make all of the above representations, you must not upload the photo.

§ 5. How the Service Works

FaceSift is an intermediary that proxies face-search requests to the FaceCheck.ID API. The Operator does not build or maintain its own facial-recognition engine.

When you upload a photo, it is transmitted over an encrypted connection to FaceCheck.ID servers for processing. The Operator does not store the photo on its own servers.

The Service offers two search modes selectable by the User:

  • Demo Mode — free of charge. The photo is submitted to FaceCheck.ID in testing mode. All result URLs are displayed without masking and no payment is required. Results are slower and intentionally inaccurate — they are generated from a test index and do not reflect real face-match data. Demo Mode is provided for evaluation purposes only.
  • Live Mode— produces real face-match results from FaceCheck.ID's production index. Result URLs are initially masked. To reveal full URLs you must complete the Unlock Payment of $1 paid by cryptocurrency via NOWPayments.

Search sessions are accessible for up to 24 hours after the search is completed, as determined by FaceCheck.ID. After this period, the session and its results are no longer retrievable through the Service.

After completing the Unlock Payment (Live Mode), you may download your Search Results as a JSON file directly to your device. The downloaded file contains result identifiers, thumbnail images, and source URLs. The Operator does not retain a copy of downloaded files.

The accuracy and completeness of Search Results depend entirely on FaceCheck.ID and its index. The Operator makes no warranties regarding the accuracy, timeliness, or legality of any Search Results. Demo Mode results are explicitly inaccurate by design.

§ 6. Payments and Refund Policy

The Service is free to use in Demo Mode. No payment is required and no payment information is collected in that mode.

The Unlock Payment applies exclusively to Live Mode. It grants access to a digital good (unmasked Search Result URLs) and costs $1 USD in cryptocurrency, processed by NOWPayments (nowpayments.io). NOWPayments accepts a wide range of crypto assets (e.g. Bitcoin, Ethereum, and others). Cryptocurrency transactions are irreversible by their nature. The Operator does not control the blockchain network and is not responsible for network fees or confirmation delays.

The Unlock Payment is tied to a single search session and is non-transferable between sessions.

Refunds. Because the Service delivers digital content instantly upon payment confirmation, the Unlock Payment is non-refundable once the unmasked URLs have been revealed to you. Cryptocurrency transactions are irreversible by their nature and cannot be reversed. If you believe an error occurred, contact facesift@gmail.com within 14 days and the Operator will review your case.

§ 7. Intellectual Property

The FaceSift name, logo, interface design, and original content are the exclusive property of the Operator. Nothing in these Terms grants you any right to use the Operator's trademarks or branding.

Search Results are indexed from third-party websites. The Operator does not claim ownership over any third-party content appearing in Search Results and does not guarantee that such content is lawfully published by those websites.

§ 8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The Operator does not warrant that the Service will be uninterrupted, error-free, or that Search Results will be accurate, complete, or up-to-date. Results depend on FaceCheck.ID's index and availability, which are outside the Operator's control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE OPERATOR IN THE 30 DAYS PRECEDING THE CLAIM.

IN NO EVENT SHALL THE OPERATOR BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

§ 9. Indemnification

You agree to indemnify, defend, and hold harmless the Operator and its affiliates, officers, agents, and employees from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law or third-party right; or (d) any content or photo you upload.

§ 10. Third-Party Services

The Service relies on the following third-party providers, each governed by their own terms and privacy policies:

  1. FaceCheck.ID — facial-search engine processing uploaded photos. Review their terms at facecheck.id/Face-Search/Terms.
  2. NOWPayments — cryptocurrency payment processor handling crypto payments for digital goods. Review their terms at nowpayments.io/doc/terms.
  3. Lenso.ai — alternative face reverse-image search engine available on the /lenso page. When you use that page, your photo is processed by Lenso.ai under their own terms. Review their terms at lenso.ai/legal/terms-and-conditions.
  4. Google Analytics(Google LLC) — web analytics service that collects aggregate usage data via cookies. Subject to Google's Privacy Policy and Terms of Service.

The Operator is not responsible for the practices, content, or availability of these third-party services.

§ 11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we handle your personal data.

§ 12. Suspension and Termination

The Operator reserves the right to restrict, suspend, or terminate your access to the Service at any time and without prior notice if you violate these Terms, applicable law, or engage in any conduct that the Operator reasonably determines to be harmful to the Service or other users.

The Operator may also discontinue the Service or any part of it at any time without liability to you.

§ 13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from or in connection with these Terms or your use of the Service shall first be attempted to be resolved amicably by contacting facesift@gmail.com.

If amicable resolution is not achieved within 30 days, the dispute may be submitted to the competent courts of the jurisdiction in which the Operator is established.

§ 14. Changes to Terms

The Operator may update these Terms at any time. The current version will always be published on this page with the effective date shown at the top. Your continued use of the Service after any update constitutes acceptance of the revised Terms.
